For purposes of this System Regulation and compliance with the Texas Women’s Privacy Act, the definitions below apply.

a. Female. An individual who naturally has or will have, or had or would have but for a congenital anomaly or an intentional or unintentional disruption, a reproductive system designed to produce, transport, and provide eggs for fertilization.

b. Male. An individual who naturally has or will have, or had or would have but for a congenital anomaly or an intentional or unintentional disruption, a reproductive system designed to produce, transport, and utilize sperm for fertilization.

c. Multiple–Occupancy Private Space. A facility designed or designated for simultaneous use by more than one individual and in which an individual may be in a state of undress in the presence of another individual, regardless of whether the facility provides curtains or partial walls for privacy. The term includes a restroom, locker room, changing room, or shower room.

(1) Temporary Redesignation of Multiple-Occupancy Private Spaces.

Notwithstanding Subsection c., a Multiple-Occupancy Private Space may be temporarily redesignated for a limited and specific purpose, provided that:

(a) the space is unoccupied by individuals in a state of undress during the period of temporary redesignation;

(b) the temporary redesignation is for authorized University business or operational purposes, including but not limited to athletic coaching, athletic training, health and wellness activities, officiating, media access, maintenance, inspections, administrative functions, or other comparable institutional needs;

(c) access is restricted to University-authorized personnel only and is limited to the duration necessary to accomplish the specific purpose; and

(d) appropriate notice, signage, or institutional controls are implemented to prevent simultaneous use by individuals for whom the facility was originally designated during the temporary period.

(2) A temporary redesignation under this subdivision does not constitute a violation of the requirement that Multiple-Occupancy Private Spaces be designated for exclusive use by individuals of one biological sex.

d. Sex. An individual's biological sex, either male or female.

e. Single–occupancy private space. A facility designed or designated for use by only one individual at a time and in which the individual may be in a state of undress. The term includes:

(1) A single toilet restroom with a locking door that is designed or designated as unisex or for use based on sex; and

(2) Sleeping quarters designed or designated for use by one individual.

a. The University hereby designates all University restrooms, locker rooms, changing rooms, and shower rooms that meet the definition of a Multiple-Occupancy Private Space for use only by individuals of one biological sex (male or female). 

b. Unless permitted under a temporary redesignation or an exception under Section 5, no individual may access a Multiple-Occupancy Private Space designated for the exclusive use of the opposite sex.

a. This Regulation does not prohibit the University from the following: 

(1) Adopting a policy necessary to accommodate an individual with a disability, a young child, or an elderly individual who requires assistance when using a multiple-occupancy private space;

(2) Establishing a single-occupancy private space, family restroom, or changing room; or

(3) Changing the designation of a multiple-occupancy private space from the use designated herein to exclusive use by individuals of the sex opposite to the previously designated sex.

b. The University is prohibited from providing an accommodation under Subsection (a) that allows an individual to use a multiple-occupancy private space designated for the exclusive use of individuals of the sex opposite to the individual's sex.

A designation of a multiple-occupancy private space under this Regulation does not apply to the following:

a. An individual entering a multiple-occupancy private space designated for the exclusive use of individuals of the sex opposite to the individual's sex:

(1) for a custodial purpose;

(2) for a maintenance or inspection purpose;

(3) to render medical or other emergency assistance;

(4) to accompany and provide assistance to an individual who needs assistance in using the facility;

(5) for a law enforcement purpose; or

(6) to render assistance necessary in preventing a serious threat to proper order or safety; or

b. A child who is:

(1) nine years of age or younger entering a multiple-occupancy private space designated for the exclusive use of individuals of the sex opposite to the child's sex; and

(2) accompanied by an individual caring for the child.

a. Employees and students are responsible for ensuring that the sex designation reflected in their official University records accurately corresponds to the individual’s biological sex at birth, as that term is defined in Section 2(d) of this Regulation.

b. The University may rely on the sex designation maintained in official University records for purposes of compliance with applicable law, including but not limited to access to sexdesignated facilities, participation in programs or activities, and enforcement of University regulations adopted pursuant to Texas law.

c. Requests to correct or update the sex designation in University records shall be limited to the correction of clerical or administrative errors and shall not be granted based on gender identity, gender expression, or subjective self-identification.

d. Employees and students are expected to cooperate in good faith with reasonable administrative processes established by the University to maintain accurate records. Knowingly providing false or misleading information regarding sex designation may result in disciplinary action in accordance with applicable University policies and procedures.

a. The designated compliance office (“Compliance”), below, at each component university is responsible for initial intake, evaluating and investigating reported violations (“Report”) of this System Regulation at the respective component university. The University will cure violations within three business days of receiving a Report. A Report is deemed to be received by the University when it is submitted to Compliance through the designated reporting link or email, below, and if it contains sufficient information to allow Compliance to investigate and cure the reported violation.

b. An allegation of a known or suspected violation may be reported to Compliance using the designated reporting link or email below.

a. The Texas Tech University System reserves the right to interpret, change, modify, amend, or rescind this regulation, in whole or in part, at any time without notice to or consent of its employees, personnel, or other members of the University community.
